ChatMe Payment Agreement
1. Agreement Overview
This Payment Agreement (hereinafter referred to as "this Agreement") applies to all payment operations conducted by you while using the ChatMe platform under Huione Group (hereinafter referred to as "the Platform"). Please carefully read and understand the contents of this Agreement before using the payment function. By using the payment function, you agree to accept all terms and conditions of this Agreement.
2. Definitions
ChatMe Platform: Refers to the online communication platform operated and managed by Huione Group, including but not limited to websites, applications, and other products and services.
User: Refers to individuals or entities registered on the Platform and using the payment function.
Payment Services: Refers to all payment operations conducted by the User through the Platform, including but not limited to recharges, transfers, and purchases of services and products.
3. Payment Account
Account Registration: Users need to register a ChatMe account before using the payment services.
Account Security: Users are responsible for safeguarding their account information and payment passwords to prevent information leakage. Huione Group does not bear any responsibility for account theft or payment password leakage caused by users.
4. Payment Methods
Supported Payment Methods: The Platform supports various payment methods, including but not limited to credit cards, debit cards, bank transfers, electronic wallets, cloud wallets, and other third-party payment tools.
Payment Process: Users should follow the prompts on the Platform when performing payment operations and ensure the accuracy of the provided payment information.
5. Fees and Taxes
Service Fees: Some payment services on the Platform may incur service fees. Specific fee standards are subject to the Platform's announcements or payment page prompts.
Tax Responsibility: Users should bear all taxes arising from the use of payment services according to the laws of their country or region.
6. User Conduct Guidelines
Legal Use: Users should comply with relevant laws and regulations and this Agreement when using payment services and must not use payment services for illegal activities.
Prohibited Conduct: Users must not engage in fraud, money laundering, or illegal transactions. If such behavior is detected, the Platform has the right to immediately terminate the user's payment services and report to the relevant law enforcement authorities.
7. Privacy Protection
Information Collection: The Platform will collect and use users' payment information with their consent, as detailed in the ChatMe Privacy Policy.
Information Protection: The Platform will take reasonable technical and management measures to ensure the security of users' payment information.
8. Disclaimer
You understand and agree that this service is provided on an "as is" basis according to the current technology and conditions. The Platform will make the best effort to provide this service and ensure its continuity and security. However, you also acknowledge and accept that the Platform cannot always foresee and prevent technical and other risks, including but not limited to service interruptions or abnormalities caused by force majeure, network reasons, or third-party service flaws. In such cases, the Platform will make the best commercial efforts to improve but is not obliged to bear any legal responsibility towards you or any third party.
The Platform may conduct maintenance, system upgrades, and adjustments. If these activities prevent you from using the service normally, you agree that the Platform does not need to bear legal responsibility.
Under any circumstances, the Platform does not bear any indirect, punitive, incidental, or consequential damage liability.
9. Breach of Agreement
If you violate this Agreement, the Platform has the right to take management measures against you or your account based on laws, relevant agreements, and Platform management regulations, depending on the specifics and severity of your actions. These measures include but are not limited to warnings, deducting or clearing your account's "coins", restricting all or part of your account's functions, and temporarily or permanently banning your account.
You understand and acknowledge that if a third party is suspected of using your account to engage in illegal activities or violate the terms of this Agreement, the Platform has the right to take management measures according to this Agreement and the relevant Platform rules to protect potential victims and other users' legal rights, maintain Platform ecological order, and prevent further damage. You should not hold the Platform responsible for this.
If you engage in or are suspected of engaging in illegal or improper behavior outside the Platform, causing the Platform to have reasonable grounds to believe that you have violated or are about to violate this Agreement or other Platform rules (such as the ChatMe User Service Agreement and the Community Self-Discipline Convention), the Platform also has the right to take management measures as stipulated in Clause 1 of this Article. You should not hold the Platform responsible for this.
10. Agreement Modification
Huione Group has the right to modify this Agreement based on business needs and will notify users through announcements or other appropriate means on the Platform. The modified Agreement takes effect immediately upon publication. Continued use of the payment services constitutes acceptance of the modified Agreement.
11. Dispute Resolution
Amicable Negotiation: In case of any dispute arising from the performance of this Agreement, the parties shall endeavor to resolve it amicably.
Jurisdiction: If negotiation fails, either party may file a lawsuit in the court of the Huione Group's domicile.
12. Supplementary Provisions
To provide you with better services, or based on legal requirements, regulatory requirements, and changes in business conditions, the Platform will revise the content of this Agreement in due course. The revised content takes effect immediately upon publication, and the Platform will release an updated version. You can check the latest version of the agreement terms at any time on the "Coins" purchase page. If you continue to use the coins service provided by the Platform after the content of this Agreement is revised, it is deemed that you agree to the latest revised content of the Agreement; otherwise, please immediately stop using this service.
Disputes arising from or related to this Agreement shall be governed by the laws of Cambodia. If any provision of this Agreement conflicts with Cambodian law or is deemed invalid or unenforceable by a competent court, these provisions will be interpreted as closely as possible to the original intent of the Agreement within the bounds of the law. Other provisions of this Agreement shall remain in full force and effect.
The place of signing this Agreement is Phnom Penh, Cambodia. Any disputes arising from or related to this Agreement shall be resolved through negotiation between the Platform and you. If negotiation fails, either party has the right to file a lawsuit in a court with jurisdiction over the place where this Agreement is signed.
